Privacy Policy

  • GENERAL
    • This Privacy Policy is DCloud's commitment to protect any data or personal information of Users of the DCloud site (PT Datacomm Diangraha) at dcloud.co.id along with its subsidiaries and affiliates (collectively, "DCloud"), its derivative sites, including but not limited to DCloud mobile applications (the "Site").
    • The Privacy Policy (including the terms of use of the DCloud site as set out in the Terms & Conditions and other information on the Site) sets out provisions for obtaining, collecting, processing, analyzing, displaying, sending, disclosing, storing, modifying, deleting and/or any form of management related to data or information that identifies or can be used to identify Users that Users provide to DCloud and/or that DCloud collects from Users or third parties ("Personal Data").
    • By clicking "Register" or a similar statement available on the DCloud registration page, the User declares that each Personal Data is true and valid, acknowledges that the User has been informed of and understands this Privacy Policy, and gives consent to DCloud to obtain, collect, process, analyze, display, send, disclose, store, modify, delete, manage and/or use such data for the purposes stated in this Privacy Policy.
  • COLLECTION OF USER PERSONAL DATA
    • Collection of personal data by DCloud is limited to information relevant to DCloud business activities and other purposes and is carried out based on consent or applicable laws and regulations.
    • User data collected includes:
      • Data submitted by the User, including but not limited to data submitted when the User uses the Site;
      • Data to create or update an account on the site, including username, email address, phone number, password, address, photo, and other information that can identify the User;
      • Data to contact DCloud, including via customer service;
      • Data to complete surveys sent by DCloud or other parties officially appointed to represent DCloud;
      • Data to interact with other Users through messaging features, product discussions, reviews, ratings, the Resolution Center (as defined in the Terms and Conditions) and other interactive features (one-way or two-way) on the Site;
      • Data to use services on the Site, including detailed transaction data such as type, amount and/or description of products or services purchased, payment channel used, transaction amount, transaction date and time, and other transaction details;
      • Data to fill payment data when Users carry out payment transactions through the Site, including but not limited to bank account data, credit card data, virtual account, instant payment, internet banking, retail outlets; and/or use features on the Site that require access permissions to relevant data stored on the User's device.
      • Data recorded when Users use the Site, including but not limited to:
        • Actual or approximate location data such as IP address, Wi-Fi location, and geo-location;
        • Time data for each User activity related to Site usage, including registration, login, and transactions;
        • User usage or preference data, including User interactions on the Site, saved choices, and selected settings. This data is obtained using cookies, pixel tags, and similar technologies that create and maintain unique identifiers;
        • Device data, including device type used to access the Site, hardware model, operating system and version, software, IMEI number, file name and version, language selection, unique device identifiers, advertising identifiers, serial numbers, device movement information, and/or cellular network information; and/or log data, including logs on servers receiving data such as device IP address, access date and time, application features or pages viewed, application processes and other system activities, browser type, and/or third-party sites or services used before interacting with the Site.
      • Data obtained from other sources, including but not limited to:
        • Data from financial service providers, including but not limited to credit rating institutions or credit information management institutions (LPIP)
        • Data from financial service providers (if the User uses specific payment features).
    • DCloud may combine data obtained from the sources mentioned above with other data it has.
    • When Users access and use the Site, cookies will be placed on the User's device to store user preferences and configurations. Cookies are not used to access other data on the User's device except for data the User has agreed to provide.
    • Users can modify their browser settings to refuse cookies, but this may cause DCloud services to not function optimally.
    • DCloud may use third-party features to improve services, promotions, and personalization based on User interests or visit history. If the User does not agree, the User can adjust it through the browser.
  • USE OF PERSONAL DATA
    • Personal Data is processed and analyzed according to DCloud needs with clear stated purposes at the time of data collection and based on consent.
    • DCloud may use Personal Data obtained and collected from Users as described in Section II for the following:
      • Process any requests, activities, and transactions carried out by Users through the Site.
      • Provide features to deliver, maintain, and improve DCloud products and services, including features that provide personalized DCloud user accounts (e.g., wishlist, cart, cancellation) and/or help Users communicate with DCloud Customer Service and improve Customer Service.
      • Contact Users via email, mail, phone, fax, and other forms of communication, including but not limited to assisting and/or resolving transaction processes or issue resolution, and conveying news or other notifications related to the protection of User Personal Data by DCloud, including failure to protect User Personal Data;
      • Use data and/or information obtained from Users for research, analysis, development and testing of Services to improve the security of services on the Site.
      • Provide Users with information related to DCloud services, promotions, studies, surveys, news, latest developments, events and other information, either through the Site or other media. DCloud may also use such information to promote, provide rewards, and present relevant ads and content about DCloud services.
      • Monitor and/or investigate suspicious transactions or transactions indicated as fraud or violations of the Terms and Conditions or applicable law, and take actions required as follow-up to the results of such monitoring and/or investigation.
      • In certain cases, if required by applicable laws and regulations in the Republic of Indonesia, use or disclose User Personal Data for law enforcement purposes or to fulfill legal and regulatory requirements, including in the event of disputes or legal proceedings between Users and DCloud, or suspected crimes such as fraud or data theft.
    • DCloud may process personal data received from third parties and/or from publicly accessible sources (e.g., customer business partners, business directories, association lists, country lists, press, media) in a permitted manner (e.g., for order/contract fulfillment, legal obligation compliance, or consent given by the Customer).
  • DISCLOSURE OF USER PERSONAL DATA
    • Personal Data collected by DCloud may not be sold, transferred, provided, or otherwise disclosed to third parties except as required by applicable laws and regulations in Indonesia.
    • DCloud will maintain the confidentiality of User Personal Data under DCloud's control and ensure there is no disclosure, sale, transfer, distribution and/or loan of User Personal Data to any third party without User consent.
    • In certain circumstances DCloud may disclose, transfer, distribute and/or loan Personal Data to third parties; however, third-party service providers, agents and/or affiliates or related companies and/or other third parties will only manage and/or use User Personal Data in connection with one or more purposes as set out in this Privacy Policy and in accordance with applicable laws and regulations. Such conditions include:
      • DCloud provides and shares User Personal Data with subsidiaries and affiliates in order to provide services or process data for and on behalf of DCloud.
      • DCloud may provide User Personal Data to partners, consultants, vendors, or similar service providers for marketing activities by third parties, improving and maintaining the quality of DCloud services, and other publication activities.
      • DCloud may need to communicate with DCloud business partners (including payment partners, feature providers, promotions and other facilities, if any) with Users to resolve issues or other matters.
      • DCloud may provide User Personal Data to third parties that use and integrate DCloud public APIs or for other purposes described in this Privacy Policy.
      • In the event that an authorized authority (in accordance with applicable laws and regulations) requests User Personal Data held by DCloud.
  • STORAGE AND SECURITY OF PERSONAL DATA
    • DCloud stores Personal Data in encrypted form.
    • DCloud seeks to maintain security and integrity for all DCloud facilities where Personal Data is stored to protect Personal Data from misuse, interference, and loss from unauthorized access.
    • DCloud implements necessary measures to safeguard Personal Data received via the website, including antivirus software protection and firewalls, and restrictions on access to computer system security.
  • DELETION OF PERSONAL DATA
    • DCloud will delete User Personal Data held by DCloud if:
      • Personal Data is no longer needed to fulfill the purpose of its collection.
      • Storage of Personal Data is no longer required for compliance with applicable laws and regulations in the Republic of Indonesia.
      • At the request and approval of the Personal Data Owner, unless otherwise required by applicable laws and regulations in Indonesia.
    • The destruction referred to above means removing some or all documents related to Personal Data, including electronic and non-electronic documents managed by DCloud, so that the Personal Data cannot be displayed again unless the User provides new Personal Data.
    • The User understands that some Personal Data may still be stored by other parties, including authorized state agencies. If DCloud shares User Personal Data with such agencies or other entities appointed by the authorized government or having cooperation with DCloud, the User agrees that storage of User Personal Data by such agencies will follow their respective data retention policies.
  • ACCESS, CORRECTION, WITHDRAWAL OF CONSENT
    • DCloud will verify User Personal Data received by DCloud. Users must provide correct and accurate data and be free from false or misleading information, and must promptly inform DCloud of any changes to User Personal Data and/or if there are errors in User Personal Data under DCloud's control. DCloud may reject, cancel, or if needed request additional information from the User.
    • The Customer may request access to the relevant Personal Data to verify that the data is accurate, complete, and up to date. The request must be submitted in writing to DCloud with sufficient identity proof.
    • DCloud may charge an administrative fee to handle requests for access rights.
    • DCloud may refuse requests for access or correction of Personal Data if, in DCloud's judgment, the request is repeated without reason, requires disproportionate technical effort, endangers other people's Personal Data, and/or for other reasons.
    • The Customer authorizes DCloud to display a statement of the Customer's Personal Data protection guarantee on the Site.
    • Unless contrary to applicable laws and regulations, Users may withdraw consent for the acquisition, collection, storage, management and use of User Personal Data by submitting a written request to DCloud. DCloud will process the request and will no longer process User Personal Data.
    • By withdrawing consent, the User is deemed to understand the consequence that the User may not use the Services and DCloud may no longer be able to fulfill its obligations related to the Services, so any legal relationship between DCloud and the User will end and cannot continue.
  • PERSONAL DATA COMPLAINTS
    • If the User has a complaint regarding Personal Data, the Customer may submit it by email to: [email protected].
    • Complaints must include identity and the nature of the complaint related to the relevant service.
    • DCloud will follow up on such complaints and provide a response.
  • PRIVACY POLICY UPDATES
    • DCloud may change or update this Privacy Policy at any time.
    • Users agree to read and revisit this Privacy Policy page from time to time to learn about changes. As long as the Customer accesses and uses DCloud services, the Customer is deemed to agree to changes in this Privacy Policy.
